These Terms set forth the legally binding terms and conditions for this website (“Site”) and/or services, features, content or applications offered by Crate (“Project” or “we”).

1. Acceptance 

By using our website, minting NFTs, acquiring tokens, engaging in Project activities, you agree to abide by these Terms, along with any additional policies and procedures posted on the Site or our official channels. These terms may be updated periodically without prior notice.

These Terms apply to all users, including, without limitation, users who are contributors of content, information, and other materials or services, registered or otherwise.

2. Eligibility 

You represent and warrant that you are at least 18 years of age. If you are under age 18, you may not, under any circumstances or for any reason, participate in any activities related to the Project. You are solely responsible for ensuring that these Terms are in compliance with all laws, Terms and regulations applicable to you. 

3. Compliance 

The Project is restricted to users in specific jurisdictions as permitted by law. 

By participating, you confirm compliance with all applicable laws. 

You assert that you are not:

a) in a country under the U.S. Government embargo 

b) not listed in any U.S. Government restricted parties list

c) you are not a resident or citizen of forbidden locations.

Prohibited actions include using software such as VPN or techniques to alter your IP address. 

We reserve the right, but have no obligation, to monitor where our Project is accessed from. Furthermore, we reserve the right, at any time, in our sole discretion, to block access to the Project, in whole or in part, from any geographic location, IP addresses and unique device identifiers or to any user who we believe is in breach of these Rules.

Crate Project is a revolutionising Gamefi (p2e) hub for crypto enthusiasts and projects, offering a dynamic platform that redefines mass adoption in the Web 3.0 era while rewarding community engagement.

What we offer: 

1. Unique Crypto Loot NFTs: Experience our AI-curated loot drops, Mint crates any time. Get rarity-ranked items to stake and use it further in the p2e stages. Each item will be in the form of an NFT.

2. Novel Auction System: Engage in our unique auction system, where you can bid on locked tokens and liquidity positions. Experience a unique auction format where participants compete using tiny, fixed-price bids, starting at $0.10. Enjoy real-time updates and transparent treasury commitments covering gas fees and rewards distribution.

3. Crate Game: Your goal is to collect the best game characters called CRATIES (opened from loot and/or traded with others) and boost items (opened or traded from Loot crates)..

Crate aims to become a worldwide Play2Earn game. This last stage is about strategic partnerships, onboarding players, ambitious growth, and a vision for the future.

In no case Crate´s Team does not provide you with recommendations to buy cryptocurrencies, sell or hold them. 

The $CRATE token is a digital asset subject to inherent risks similar to other cryptocurrencies. These risks encompass, but are not limited to, potential loss of value or complete investment. 

The value of the $CRATE token can exhibit significant volatility and unpredictability, potentially resulting in substantial financial losses. By engaging in the purchase, holding, or trading of $CRATE tokens, you explicitly acknowledge and assume these risks.

The $CRATE team does not partake in undisclosed transactions involving $CRATE tokens in any capacity. • NFTs 

Users can mint our Crate NFTs, which could be burned for tokens, staked or swapped with other users and used later in the game. All NFTs will produce yield which depends on the items category (common, rare, exceptional).

NFT usage Disclaimer

Minting of crates containing NFTs is subject to availability and may be conducted at any time at the discretion of the platform.

Each crate contains items categorised as Common, Rare, or Exceptional NFTs. The distribution percentage for each category is as follows: Common (87%), Rare (10%), and Exceptional (3%).

NFT items obtained from minted crates can be utilised in various ways, including burning for tokens, staking, swapping with other users, and usage in the play-to-earn (P2E) stages of the game.

The yield generated from each category of NFT item may vary. Common items typically produce minimal yield, while Rare items yield an average return. Exceptional items yield the highest returns and may grant exclusive accesses within the game.

Holders of minted crates have the discretion to decide when to transform them into opened crates containing items. No reveal process is required for this transformation. NFTs obtained from minted crates can be held as collectibles, redeemed for their utility later, or sent as unique gifts to other users.

By participating in the minting process and obtaining NFTs from Crates, you acknowledge that the items obtained are digital assets subject to the terms outlined above and may be subject to future changes or updates by the Project in our sole discretion.

6. Proprietary rights 

All intellectual property related to and all rights, title, and interest in and to the Site, Services, modifications, and derivative works thereof, as between you and us, shall remain the sole property of the Project. You shall not take any action that would violate, jeopardise or impair such intellectual property or ownership rights, or the legality and/or enforceability thereof. The Loots, NFTs, any design, technology and other related intellectual property are protected under copyright, trademark and other intellectual property laws and other applicable law. 

7. Warranty disclaimer 

We have no special relationship with or fiduciary duty to you. You acknowledge that we have no duty to take any action regarding:

1. your trading results;

2.  what Content you access via the Site; or

3.  how you may interpret or use the Content.

You release us from all liability for you having acquired or not acquired Content through the Site. We make no representations concerning any Content contained in or accessed through the Site, and we will not be responsible or liable for the accuracy, copyright compliance, or legality of material or Content contained in or accessed through the Site.
